General terms and conditions

These general terms and conditions apply to all offers, agreements, and deliveries from Arena Woodworks , based in Oldenzaal, hereinafter referred to as “we” or “our company”. By placing an order, you agree to these general terms and conditions.

1. General

1.1. These general terms and conditions apply to all products manufactured and delivered by Arena Woodworks .

1.2. Deviations from these general terms and conditions are only valid if agreed upon in writing.

1.3. If any provision of these terms and conditions is found to be null and void or annulled, the remaining provisions shall remain fully in effect.

2. Use, maintenance, and storage of the products

2.1. Our products are designed for seating and playing poker.

2.2. The careful handling of the products is the responsibility of the customer. No liability is accepted for damage resulting from the following circumstances:
- Constant exposure to temperatures below 4°C or above 40°C;
- Exposure to sharp objects, heavy loads, or extreme pressure;
- Contact with moisture, water, fire, corrosive substances, or other harmful materials.

2.3. Damage resulting from improper use, maintenance, or storage is entirely the responsibility of the customer.

3. Warranty

3.1. We guarantee that our products meet the specifications stated at the time of purchase and are free from manufacturing defects. The warranty is limited solely to the construction and stability of the products.

3.2. The warranty does not apply to wear and tear of consumable parts, including but not limited to the playing surface and the rail.

3.3. The warranty does not cover damage or defects resulting from:
- Careless use, maintenance, or storage as described in Article 2;
- Modifications or alterations made by third parties;
- Negligence or improper handling.

4. Liability

4.1. Arena Woodworks is not liable for any damage, whether direct or indirect, arising from:
- The use, maintenance, or storage of the products in violation of the conditions described;
- The use of the products for purposes other than those for which they were designed.

4.2. Our liability is in all cases limited to the amount paid by the customer for the respective product.

5. Force Majeure

5.1. Arena Woodworks is not liable for any failure to fulfill the agreement if such failures are due to force majeure, including but not limited to: natural disasters, fire, floods, pandemics, or other extraordinary circumstances beyond our control.

6. Applicable Law

6.1. These general terms and conditions, as well as all agreements between Arena Woodworks and the customer, are exclusively governed by Dutch law.

6.2. Disputes arising from or related to these general terms and conditions shall be exclusively submitted to the competent court in the Netherlands.

7. Final Provisions

7.1. Arena Woodworks reserves the right to modify these general terms and conditions. The most recent version is always available on our website.

7.2. By placing an order, the customer agrees to the most current version of these general terms and conditions.
